External Examiners Associate Course

It is anticipated participants on completion of this course, will be able to:

1. Describe the system of regulation for law practices, approved clerks in Victoria and barristers in New South Wales.
2. Describe their role within the Financial Assurance Scheme and the expectations of the DLRA in regard to the completion of an External Examiners Report.
3. Describe and exercise appropriately the powers of an External Examiner.
4. Identify and differentiate between the various types of trust money and trust records to be maintained for trust money held by law practices, approved clerks in Victoria and barristers in NSW.
5. Describe the nature of trust money transactions (such as standard conveyance, the administration of an estate and general litigation matters), providing examples of the types of transactions involving trust money and problems that may arise with trust money transactions;
6. Review trust money transactions, ensuring that the monies have been dealt with appropriately and in accordance with applicable rules and regulations.
7. Identify the various forms required to be submitted by law practices, approved clerks in Victoria, barristers in NSW and the external examiners.
8. Prepare an External Examiner’s Report:
8.1 by conducting an efficient and effective examination of trust monies and associated record keeping,
8.2 by formulating an opinion on whether the records maintained for the various types of trust money received have been kept in accordance with trust account rules.
8.3 in accordance with the DLRA requirements

Successful completion of the course of education will be attendance at all sessions of the course and submission of an online assessment drawn from the session notes provided at the course.

You will receive a certificate of attendance which does not entitle you to accept appointments as an External Examiner to law practices.
