Aims
This paper discusses recent decisions under the Succession Act which came into force on 1 March 2008 and the evidentiary material that should be obtained to enable the Court to make a family provision order.
The strategies that can be implemented to make a claimant have better prospects of success are also discussed.
The paper also looks at some recent decisions where the eligible person and the deceased have been estranged for many years.
