Two recent NSW Court of Appeal decisions have examined whether a mortgagee has an indefeasible interest over the whole of the property - when one joint tenant forges the signature of the other.

This presentation reviews and critiques the outcome of these two decisions. It also provides an overview of claims against the Torrens Assurance Fund, the impact of the Civil Liability Act on claims against third parties that have arisen from a mortgage fraud scenario and the benefits of title insurance.
