Dr Philip Bender, barrister, will review the new cross border insolvency legislation that was recently introduced in Australia. The legislation implements the United Nations Model Law on cross-border insolvency. It is of particular practical relevance to both domestic and foreign creditors as well as debtors and liquidators/administrators. The legislation together with the application of complementary Federal Court Rules will provide a mechanism for foreign creditors and liquidators/administrators to commence and participate in Australian insolvency proceedings and seek relief from Australian courts. It also has a similar effect for Australian creditors and liquidators whenconducting litigation in foreign courts.
