The Family Law practitioner is often confronted with a situation of needing to deal with either existing AVOs or fresh AVOs that are served on their client. The purpose of this CLE is to educate practitioners about how AVOs impact on family law and vice versa. This CLE will address the following:.
What to do when your family law client is served with an AVO;.How AVOs impact on family court orders and applications for parenting Orders;.Your obligations as a family lawyer when your client is involved in AVO proceedings;.What conditions should be sought or accepted under an AVO and their meaning;.Restraints on parties attending the home; andThe similarities and differences between an AVO made under the Crimes (Domestic and Personal Violence) Act 2007 in the Local Court and a family violence order made under the Family Law Act 1975 in the Family Court or the Federal Magistrates Court.
