This paper addresses the Environmental Planning and Assessment Amendment (Part 3A Repeal) Act 2011 which passed Parliament on 22 June 2011.

This paper provides an update on the recent changes.

It addresses the repeal of Part 3a of the Act and how development previously dealt with under that Part will be managed in the future.

In addition, it explains the new State significant development and State significant infrastructure regimes and reviews the saving and transitional provisions.

Robert Moses is a partner in the Sydney office of Holding Redlich and previously worked for the NSW Department of Planning.
