Aims

In Michael Connolly's paper, he reviews some of the key cases including John Holland, Chevally and Grugeon and Stratabuild that have been brought since the High Court decision in Kirk.

He considers the arguments raised and the way the relevant Courts have dealt with each matter. He also reviews how Kirk has changed the way in which WorkCover is now approaching the framing of OHS charges.

John Makris then explores the proposed changes under the Model Work Health & Safety Act (Cth) and the new harmonisation of state and territory OHS regulations. The paper looks at how the changes impact upon business and the challenges moving forward.
