Aims
The paper provides commentary on:
- Hili v The Queen – the sentencing judge’s discretion reinvigorated?
- ICOs – gaol without incarceration
Mr Bromwich considers the consequences (some of them less obvious than others) of the recent High Court decision of Hili v The Queen, in which the court unanimously stripped back judicial sentencing "norms" in favour of other approaches to consistency in sentencing.
He also considers the recent intoduction of "Intensive Corrections Orders", which replaced Periodic Detention from 1 October 2010.
